最近加拿大境內續簽的時(shí)間突然變得很長(cháng)，學(xué)簽和工簽續簽審理時(shí)間一度超過(guò)兩個(gè)月，本來(lái)不是很受關(guān)注的一個(gè)問(wèn)題被經(jīng)常提出：如果我已經(jīng)遞交了續簽的申請，新的身份還沒(méi)有下來(lái)，舊的身份已經(jīng)過(guò)期了，我可以合法呆在加拿大嗎？

答案是肯定的，此時(shí)申請人的身份就屬于Implied Status, 目前還沒(méi)有統一的翻譯，姑且叫做“含蓄身份”好了。

申請人只要在身份過(guò)期之前遞交了續簽申請身份，無(wú)論是續訪(fǎng)問(wèn)者身份，旅游簽轉學(xué)簽，續學(xué)簽，還是續工簽，在新的申請審批完成之前，都可以繼續合法留在加拿大。

以下情況下申請人還可以繼續合法學(xué)習和工作。

1. 學(xué)簽持有人在遞交學(xué)簽續簽申請之后，即使原來(lái)的身份過(guò)期，也可以繼續學(xué)習，依據IRPR 189;

189. A foreign national who has made an application under subsection 217(1) is authorized to study without a study permit until a decision is made on the application if they have remained in Canada since the expiry of their study permit and continue to comply with the conditions, other than the expiry date, set out on the expired study permit.

對于一般的境內續簽申請，我們建議申請人及早遞交。晚交雖然原先的身份失效后還有Implied Status，但是一旦新的申請被拒簽，申請人在加拿大的身份就立刻失效了，只能申請恢復身份。反之如果被拒簽時(shí)申請人原來(lái)的身份依然有效，只用重新遞交一份新的續簽申請就好。

但有的時(shí)候，合理利用Implied Status可以起到神奇的效果。

獲得加拿大國籍有什么條件？

在加拿大出生，自動(dòng)獲得加拿大國籍。

其他人類(lèi)的申請條件

1. 擁有加拿大永久居民身份;

2. 在過(guò)去5年中在加拿大呆夠1095天。在加拿大以臨時(shí)居民身份逗留的時(shí)間一天按半天計算，最多計算為365天;

3. 按加拿大聯(lián)邦及各省及領(lǐng)地的稅法，按時(shí)報稅交稅并上交納稅記錄。換言之，Canada Revenue Agency的NOA(Notice of Assessment).

4. 有一定的英語(yǔ)或者法語(yǔ)基礎。需要上交語(yǔ)言成績(jì);

5. 參加入籍知識考試。

6. 無(wú)刑事犯罪記錄。
