隨著(zhù)人們商標意識的增強，藥品商品名稱(chēng)的商標化已成為趨勢。由此，在藥品的商品名稱(chēng)尋求商標保護的過(guò)程中，商標與藥品名稱(chēng)的沖突也就大量出現。如有的商標注冊與他人在先取得的合法權利相沖突;有的違反了商標注冊不得使用通用名稱(chēng)的規定以及不得直接表示商品質(zhì)量、功能的要求等等，引起很大的混亂?！叭盼柑?、“21金維他”、“散利痛”……都在其列。在這里，商標與藥名原本不是一個(gè)行業(yè)領(lǐng)域的兩碼事，但在藥品的商業(yè)流通中攪在了一起，鬧出不少是是非非。
