法律文書(shū)中consideration有幾種譯法

最常見(jiàn)的，在英美法的合同法中，consideration翻譯成“對價(jià)”最合適，在合同contract中， 一方提出某種promise， 提供某些物品或者服務(wù)； 另一方提供consideration，一般是cash或者是 cash-convertible （支票 禮物Gfits）作為代價(jià)， 這個(gè)合同就是有法律效力的。另外一個(gè)比較常見(jiàn)的翻譯是“約因”，這個(gè)意思下相當于cause了。

法律文書(shū)中consideration有幾種譯法

consideration是法律英語(yǔ)中極具代表性的一個(gè)術(shù)語(yǔ)，不僅因為其在法律英語(yǔ)中所表達的含義的特殊性，更因為其重要性。

我們知道consideration基本含義是“考慮”，但在法律合同中，它主要有兩個(gè)用法，(1) 作為鑒于條款，以in consideration of 這樣的短語(yǔ)出現；和(2) 譯為“對價(jià)”。
