商標右上角的TM是什么意思

“TM”是“商標”的英文“trademark”的縮寫(xiě)，“®”是“注冊”的英文“register”的縮寫(xiě)?！癟M”和“®”都起提示性作用，通常它們都出現在一些標志的右上角或右下角，“TM”表明聲明該標志是作為商標使用，而“®”則表明該標志已經(jīng)是注冊商標，享有商標專(zhuān)用權。

我國法律對®的使用有明確的規定，但對TM的使用和管理沒(méi)有規定，只要是經(jīng)營(yíng)者想告知他人某標志是其作為商標使用的標志，無(wú)論該標志是否申請商標注冊，都可以使用“TM”標識。但必須明確的是，“®”作為注冊商標特殊符號，只有在商標正式注冊后才能標注，否則就是假冒商標，會(huì )受到處罰。帶“TM”標識的商標如果跟已注冊商標相同或近似，則構成對其他商標侵權，也會(huì )受到處罰。還有，帶“TM”標識的商標如果不及時(shí)注冊，其他企業(yè)搶注了這個(gè)商標，那么他人搶注的商標正式注冊后，這家企業(yè)也不能再使用這個(gè)帶“TM”標識的商標，否則就構成侵權。

商標右上角的TM是什么意思

在中國，商標上的TM也有其特殊含義，其實(shí)TM標志并非對商標起到保護作用，它與R不同，TM表示的是該商標已經(jīng)向國家商標局提出申請，并且國家商標局也已經(jīng)下發(fā)了《受理通知書(shū)》，進(jìn)入了異議期，這樣就可以防止其他人提出重復申請，也表示現有商標持有人有優(yōu)先使用權。用圓圈R，是“注冊商標”的標記，意思是該商標已在國家商標局進(jìn)行注冊申請并已經(jīng)商標局審查通過(guò)，成為注冊商標。圓圈里的R是英文register注冊的開(kāi)頭字母。注冊商標具有排他性、獨占性、唯一性等特點(diǎn)，屬于注冊商標所有人所獨占，受法律保護，任何企業(yè)或個(gè)人未經(jīng)注冊商標所有權人許可或授權，均不可自行使用，否則將承擔侵權責任。用TM則是商標符號的意思，即標注TM的文字、圖形或符號是商標，但不一定已經(jīng)注冊（未經(jīng)注冊的不受法律保護）。TM是英文trademark的縮寫(xiě)。
