假釋的實(shí)質(zhì)條件有哪些？

(一)適用假釋的對象條件

適用假釋的對象只能是被判處有期徒刑和無(wú)期徒刑的犯罪分子。

在適用假釋的對象條件中還有一個(gè)限制條件，即對累犯以及因殺人、爆炸、搶劫、強奸、綁架等暴力性犯罪被判處10年以上有期徒刑、無(wú)期徒刑的犯罪分子，不得假釋。

(二)適用假釋的刑期條件

被判處有期徒刑、無(wú)期徒刑的犯罪分子只有執行了一定的刑期之后才能適用假釋?zhuān)驗橹挥型ㄟ^(guò)一定時(shí)間的刑罰執行，才能確切地掌握犯罪分子是否有悔改表現，是否會(huì )再危害社會(huì )。

(三)適用假釋的實(shí)質(zhì)條件

被判處有期徒刑、無(wú)期徒刑的犯罪分子在刑罰執行期間，必須認真遵守監規，接受教育改造，確有悔改表現，不致再危害社會(huì )。

對于犯罪分子的假釋?zhuān)勒招谭ㄒ幎ǖ某绦蜻M(jìn)行。非經(jīng)法定程序不得假釋。

假釋的實(shí)質(zhì)條件有哪些？

　假釋?zhuān)菍Ρ慌刑幱衅谕叫?、無(wú)期徒刑的犯罪分子，在執行一定刑期之后，因其遵守監規，接受教育和改造，確有悔改表現，不致再危害社會(huì )，而附條件地將其予以提前釋放的制度。關(guān)于適用假釋的條件，根據刑法第81條的規定，假釋必須符合以下條件：

　　1.適用假釋的對象條件，只能是被判處有期徒刑的犯罪分子和被判處無(wú)期徒刑的犯罪分子兩種人。被判處管制的犯罪分子因本身是不予關(guān)押，不存在假釋問(wèn)題;被判處拘役的犯罪分子因刑期較短，也不必要規定假釋制度;死刑犯也不存在假釋問(wèn)題，被判處死緩的犯罪分子本身也不存在假釋問(wèn)題，要有也是發(fā)生在改為無(wú)期徒刑或者有期徒刑以后。在適用假釋的對象條件中，有例外情況，即對累犯以及因殺人、爆炸、搶劫、強奸、綁架等暴力性犯罪被判處10年以上有期徒刑、無(wú)期徒刑的犯罪分子，不得假釋。

　　2.適用假釋的刑期條件，必須是被判處有期徒刑的犯罪分子，實(shí)際執行原判刑罰二分之一以上;被判處無(wú)期徒刑的犯罪分子，實(shí)際執行原判刑罰10年以上。這樣規定一方面是為了維護法律的嚴肅性，保證被判刑的犯罪分子要實(shí)實(shí)在在服幾年刑，受到應有的懲罰、教育和改造;同時(shí)，也只有在對被判無(wú)期徒刑和有期徒刑的人實(shí)際執行一定的刑期，經(jīng)過(guò)一段時(shí)間的改造以后，執行機關(guān)和司法機關(guān)才能據此分析犯罪分子的悔改情況，判斷是否會(huì )再危害社會(huì )，才能保證適用假釋的準確性。在適用假釋的刑期條件中，也有一個(gè)例外規定，即如果有特殊情況，經(jīng)最高人民法院核準，可以不受上述執行刑期的限制。這一規定體現了原則性與靈活性的統一。這里所謂的“特殊情況”，主要是指出于國家政治、國防、外交等方面特殊需要。

　　3.適用假釋的實(shí)質(zhì)條件，是犯罪分子認真遵守監規，接受教育改造，確有悔改表現，假釋后不致危害社會(huì )。只有符合這樣的條件才能假釋?zhuān)痪邆渖鲜鰧?shí)質(zhì)條件的，即使對象條件和已服刑期條件都已經(jīng)達到，也不能適用假釋。是否認真遵守監規，接受教育改造，可以通過(guò)犯罪分子的平常表現考察出來(lái);而是否“確有悔改表現、假釋后不致危害社會(huì )”，只能是結合犯罪分子現實(shí)表現以及其他各方面情況來(lái)進(jìn)行預測。犯罪分子在勞動(dòng)改造期間一貫遵守監規，接受教育改造，并通過(guò)教育、改造和學(xué)習，對自己所犯罪行有較深刻的認識，決心以實(shí)際行動(dòng)痛改前非，改惡從善，保證釋放后不會(huì )重操舊業(yè)或從事違法犯罪等危害社會(huì )的行為，一般可認為確有悔改表現，不致再危害社會(huì )。

在一般情況下，適用假釋的上述三個(gè)條件必須同時(shí)具備，缺一不可;只具備其中一個(gè)或者兩個(gè)條件的，不得適用假釋。
