北京外所,第一年標準價(jià)RMB8,000,年底雙薪,年薪可到RMB100,000。
每年會(huì )有一次review的機會(huì )。因此,雖然各所第一年起步相同,但是
第二年就會(huì )拉開(kāi)很大差距。例如,同是去年,一家英國大所給legal
assistant加薪50%,而另一家美國所就只有nominal increase。
上海外所的水平與北京相當。
以上信息只是針對外所大所而言,例如英國的magical circle,或美國的
top tier firms.
在上海的外資所也就是這個(gè)待遇了,一模一樣的:8,000/month.不過(guò)做完第一年以后revi
ew分數最高的工資能夠double,但是不能馬上拿到,要簽個(gè)協(xié)議,兩年內不跳槽才能完全拿
到,所以第二年實(shí)際是12,000/month左右.
這是比較prestigious的美國所.在上海,entry-level工資最高的不是美國所,而是一家英
國所,本科應屆畢業(yè)生的entry-level工資是12,000/month,第二年還能繼續漲,不過(guò)幅度
相當有限.
要進(jìn)外資所的競爭肯定很激烈,但是最主要的還是network.招進(jìn)去的人未必是讀書(shū)最好的
但肯定是在里面做過(guò)summer/winter associate,拿過(guò)該所的獎學(xué)金,或者有network的.
當然也有人直接投簡(jiǎn)歷就進(jìn)去的,但概率比較小.
另外,localization是現在的趨勢,不要指望在美國被派到中國,工資就會(huì )和美國一個(gè)標準
.好多人是在美國被interview的,但這和在美國被employ是完全兩碼事.每個(gè)firm都會(huì )參
照domestic level來(lái)覺(jué)得自己在當地的薪資水平.要指望在美國讀個(gè)LLM(甚至JD),馬上就
能被當作expat到中國來(lái)工作,倘若以前的背景不是非常outstanding的,或者手里有現成
的client的,恐怕希望比較渺茫.
報酬應該和創(chuàng )造的價(jià)值掛鉤。Wall street law firm的可以開(kāi)到起薪$125,000,但在中
國就不切實(shí)際??梢院?jiǎn)單的算一筆帳,一個(gè)剛剛qualified的associate的hourly rate
$250,一年billable hours target是1800小時(shí),一年只能給老板創(chuàng )造$450K的價(jià)值。更
何況有哪家所的China practice associates可以作到1800小時(shí)的??紤]到在NY和BJ開(kāi)所
的成本,如果哪個(gè)合伙人給每個(gè)

畢業(yè)生都開(kāi)$150K,這家的China Practice肯定是賠本生意,也長(cháng)久不了。不過(guò),不排除這些海龜能帶來(lái)業(yè)務(wù)的,待遇肯定就有不同。

事實(shí)上,即使在美國,要找entry-level $125,000/year的firm也絕對不是那么容易的事
哪怕你是土生土長(cháng)的美國人,沒(méi)有語(yǔ)言和文化背景的障礙。否則,為什么法學(xué)院學(xué)生
之間的競爭會(huì )如此激烈?為什么大家讀完第一年以后的暑假就要那么緊張的尋找summer
associate的position?
道理很簡(jiǎn)單 -- 真正好的top firm就那么幾家,數都數的過(guò)來(lái),position卻只有那么幾
個(gè)。沒(méi)有做過(guò)某個(gè)所的summer associate,以后畢業(yè)的時(shí)候就很難再加入該所(有特例
但不多)。所以大家才會(huì )拼命的讀書(shū),拼命的爭排名,拼命的爭取進(jìn)入一個(gè)優(yōu)秀的所
做summer associate。為的什么?就是因為畢業(yè)后的就業(yè)競爭太激烈!

我對你說(shuō)的話(huà)不表示懷疑。問(wèn)題是你說(shuō)的這些人的背景不可能是很usual的,尤其是后兩
個(gè)人。在中國不作為expat能拿到這樣薪水的人只有三類(lèi):
1)partner;
2)senior associate with significant experience (say, more than 8 years and i
n the area where the firm urgently needs to expand its business);
3)people who can bring important client network to the firm;
所以如果斷章取義的說(shuō)某某人在哪里哪里讀完LLM/JD后就拿多少多少錢(qián),恐怕有點(diǎn)誤導
這里那么多本來(lái)已經(jīng)很“”“躍躍欲試”的年輕土兔們的傾向。(sorry, no o
ffense to you)
要知道,學(xué)位本身和賺錢(qián)多少并沒(méi)有必然聯(lián)系。對firm,對老板而言,真正make sense
的不是那個(gè)學(xué)位。他們不會(huì )關(guān)心你的學(xué)位本身,在考慮你的薪資水平的時(shí)候,經(jīng)驗絕對
是第一位的!因為在律師這一行里,在某種程度上,experience=clients.
學(xué)位當然也會(huì )考慮。但是他們考慮的更多的是你這個(gè)學(xué)位能帶給firm哪些practical va
lue.舉個(gè)例子來(lái)講:如果因為你讀了這個(gè)學(xué)位,你有了foreign jurisdiction qualifi
cation,因此你的hourly charge高了;相應的,firm的profit也高了。在這樣的情況下
學(xué)位才會(huì )被考慮為一個(gè)重大的因素。
所以那個(gè)從美國回國拿15萬(wàn)的JD對我而言一點(diǎn)都不是surprise.倘若你沒(méi)有中國法學(xué)院的
法學(xué),沒(méi)有相關(guān)的工作經(jīng)驗(好多在美國讀JD的都是一路讀上去的從來(lái)沒(méi)有任
何工作經(jīng)驗的其它專(zhuān)業(yè)的碩士博士,生物,教育,傳媒,歷史, 社會(huì )學(xué),等等,樣樣都
有),甚至還沒(méi)有美國的qualification,我個(gè)人認為在中國給15萬(wàn)已經(jīng)屬于相當不錯的
了。

給大家舉3個(gè)真實(shí)的例子來(lái)說(shuō)明現在的market level:
firm 1:在上海的美資所,全美排名top 25。在該firm工作了三年的L/C,從美國top 5的
law school拿完LLM學(xué)位后回去做1st year associate,出去前是160,000 - 180,000/y
ear,回來(lái)以后是300,000 - 350,000/year (depending on annual performance revie
w),請注意這是post-qualification. 當然以后還會(huì )漲,但多少取決于你自己的perfor
mance. 而且該所的policy是LLM基本只招自己出去的L/C,沒(méi)有在其它同檔次的所做過(guò)的
光是讀了個(gè)LLM的,簡(jiǎn)歷連partner手里都送不到;
firm 2:在上海的top英資所,有2年government experience和6年anti-dumping experi
ence的associate(其中1年是在美國做intern),從美國top 10的law school回來(lái)(LLM
),工資是500,000 - 600,000/year. Again, this is post qualification level;
firm 3:在北京的美資所(always ranked top 3 by many authorities in Asian pract
ice),中國的top law school本科+研究生畢業(yè),四年相關(guān)行業(yè)的政府工作經(jīng)驗,美國t
op 15 law school的JD,回去first year 450,000 - 500,000/year.
你可以從中看出點(diǎn)名堂的,究竟是學(xué)位本身重要,還是工作經(jīng)驗重要。
最后補充一點(diǎn):現在在中國的大部分外資firm都傾向于招自己的L/C再讀完LLM回來(lái)的做
associate,出去前沒(méi)有非常好的外資所的工作經(jīng)驗的,回去要馬上達到case 1里面這樣
水平,不要說(shuō)被聘用難,就是聘用了也沒(méi)有這點(diǎn)錢(qián)。
說(shuō)了那么多,不是要給大家潑冷水。只是當你下定決心要花大量的時(shí)間、精力、金錢(qián)去
做某件事之前,最好還是好好了解一下它能最終帶給你的,與你的expectation和心理承
受能力究竟距離有多遠。
